By accessing or using Memorial's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. Memorial provides digital memorial services that allow users to create, manage, and share online memorials for their loved ones.

2. Description of Service

Memorial provides a platform for creating digital memorials, including photo galleries, life stories, virtual offerings, and family sharing features. We strive to provide a respectful and secure environment for preserving memories. The service is available through our mobile applications on iOS and Android platforms.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

You retain ownership of all content you submit to Memorial. By uploading content, you grant us a license to use, store, and display your content as part of the service. You are solely responsible for ensuring that your content does not violate any third-party rights or applicable laws.

5. Prohibited Conduct

When using our services, you agree not to:

• Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Impersonate any person or entity
• Interfere with or disrupt the service or servers
• Attempt to gain unauthorized access to any part of the service
• Use the service for any commercial purpose without our consent
• Violate any applicable laws or regulations

6. Intellectual Property

Memorial and its original content, features, and functionality are owned by Memorial and are protected by international copyright, trademark, patent, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

7. Termination

We may terminate or suspend your account at any time without prior notice for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the service will immediately cease.

8. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free. We are not responsible for any loss of data or content.

9. Limitation of Liability

To the maximum extent permitted by law, Memorial shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the service. Our total liability shall not exceed the amount you paid us, if any, in the past twelve months.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the updated terms on our platform. Your continued use of the service after such changes constitutes acceptance of the new terms.

11. Subscription Services

Memorial offers optional premium subscription plans that provide additional features and benefits. By subscribing to a premium plan, you agree to the following terms.

11.1 Subscription Plans

We offer the following subscription options:

• Monthly Plan: $4.99 per month with 20 Memorial Coins per month
• Yearly Plan: $39.99 per year (equivalent to $3.33/month, 33% savings) with 30 Memorial Coins per month
• Lifetime Plan: One-time payment of $89.99 with 50 Memorial Coins per month for life

11.2 Free Trial

New subscribers may be eligible for a 3-day free trial. During the trial period, you have full access to premium features. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee.

11.3 Auto-Renewal

Monthly and Yearly subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your payment method will be charged within 24 hours prior to the end of the current period. You can manage and cancel your subscription through your device's account settings (App Store for iOS or Google Play Store for Android).

11.4 Billing

All subscription payments are processed through Apple App Store (for iOS) or Google Play Store (for Android). Prices are displayed in your local currency and may vary based on your region. Any applicable taxes will be added to the displayed price.

11.5 Subscription Cancellation

You may cancel your subscription at any time through your device's account settings. Upon cancellation, you will retain access to premium features until the end of your current billing period. No partial refunds will be provided for the unused portion of your subscription period.

11.6 Memorial Coins

Premium subscribers receive Memorial Coins as part of their subscription benefits. Coins are credited monthly and can be used to purchase virtual offerings and gifts. Unused coins do not expire as long as your account remains active. If you cancel your subscription or request a refund, any bonus coins received as part of the subscription may be deducted from your account.

12. Refund Policy

We want you to be satisfied with your purchase. Please review our refund policy below.

12.1 Subscription Refunds

Refund requests for subscriptions are handled by Apple (for iOS) or Google (for Android) in accordance with their respective refund policies. To request a refund, please contact Apple App Store Support or Google Play Support directly through your device's settings or the respective support websites.

12.2 Coin Deduction on Refund

If a refund is granted for a subscription purchase, any Memorial Coins that were credited as part of that subscription will be deducted from your account. If you have already used some or all of the coins, the equivalent value may be deducted from future coin credits or your coin balance may become negative until replenished.

12.3 Non-Refundable Items

Virtual offerings and gifts purchased with Memorial Coins are non-refundable once sent to a memorial. Lifetime subscriptions may be eligible for refund within 14 days of purchase if premium features have not been substantially used.

12.4 How to Request a Refund

For iOS users: Open Settings > Apple ID > Subscriptions, or visit reportaproblem.apple.com. For Android users: Open Google Play Store > Menu > Account > Purchase History, or visit play.google.com/store/account.
